Terms of Service

These Terms of Service (“Terms”) govern your access to and use of The Black Ledger website, products, and services (collectively, the “Service”). The Service is operated by Caden K, a sole proprietor based in British Columbia, Canada (“we,” “us,” “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. What The Black Ledger Is
The Black Ledger is an information service. We monitor publicly available on-chain trading activity on Polymarket and send alerts to subscribers based on defined patterns. The Service is a software tool that delivers information.
The Black Ledger is not:
- A financial advisor, broker, dealer, or investment manager
- A regulated financial service or securities platform
- A custodian of user funds, wallets, or private keys
- An execution platform — we do not place trades on your behalf
- A guarantee of trading profits or any specific outcome
Subscribers are responsible for their own trading decisions. Information provided by the Service is not financial, legal, investment, or tax advice.
2. Eligibility
To use the Service, you must:
- Be at least 18 years old
- Not be a resident of, or physically located in, the United States of America
- Not be a resident of any jurisdiction where prediction market access is prohibited
- Be legally able to enter into binding contracts in your jurisdiction
- Comply with all applicable laws in your jurisdiction regarding prediction markets, cryptocurrency, and information services
Polymarket is restricted to non-US users per CFTC regulations. The Black Ledger does not support, encourage, or facilitate US users accessing Polymarket. If you are a US resident, you must not use this Service.
You are solely responsible for determining whether your use of the Service is legal in your jurisdiction. We make no representation that the Service is appropriate or available for use in any particular jurisdiction.
3. Accounts and Subscriptions
Account creation requires a valid email address. Paid subscriptions (“Pro tier”) require a valid payment method.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Providing accurate and current information
We may suspend or terminate accounts that:
- Violate these Terms
- Engage in fraud, abuse, or misuse of the Service
- Attempt to resell, redistribute, or automate access to the Service without authorization
- Appear to be operated by or on behalf of US residents
4. Fees and Billing
Paid subscriptions are billed in advance on a monthly basis via the payment method you provide.
- Fees are listed on the Service's pricing page at the time of purchase
- Fees may be adjusted with at least 30 days' notice to existing subscribers
- Cryptocurrency payments, once confirmed on the blockchain, are final except as provided in the Refund Policy
- Card payments are processed by third-party payment processors (currently Stripe); we do not store full payment card details
5. Cancellation and Refunds
You may cancel your subscription at any time. Cancellation stops the next billing cycle; you retain access through the end of your current paid period.
Refunds are governed by our Refund Policy, which forms part of these Terms.
6. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable law
- Attempt to reverse engineer, decompile, or extract the source code of the Service
- Scrape, harvest, or automate data collection from the Service beyond normal user access
- Resell, sublicense, or redistribute Service content or alerts without written permission
- Share your account credentials with others or allow multiple people to use a single account
- Use the Service to harass, defame, or harm any individual or entity
- Circumvent, bypass, or attempt to bypass any access restrictions or security measures
- Use the Service from a jurisdiction where it is prohibited
Automated access (scraping, data mining, crawling) is prohibited except as explicitly allowed by our robots.txt and llms.txt files.
7. Intellectual Property
All content, software, trademarks, logos, text, graphics, and other materials on the Service are owned by Caden K or licensed to us. You are granted a limited, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms.
You do not acquire any ownership rights in the Service or its content.
The names “The Black Ledger,” “The Scanner,” and associated logos are trademarks of Caden K (whether registered or unregistered).
8. User Content
If you submit feedback, suggestions, or other content to us (including waitlist form responses), you grant us a worldwide, royalty-free, perpetual license to use that content for any purpose, including improving the Service. We will not publicly attribute feedback to you without your consent.
9. Third-Party Services
The Service relies on third-party services including but not limited to:
- Polymarket — the source of on-chain trading data we monitor
- Polygon blockchain — the network on which Polymarket operates
- Stripe — payment processing for card-based subscriptions
- NOWPayments (if enabled) — payment processing for cryptocurrency subscriptions
- Supabase — database and authentication infrastructure
- Resend — transactional email delivery
- Telegram — alert delivery
- Vercel — hosting and content delivery
- Cloudflare — DNS and network infrastructure
We are not responsible for the availability, accuracy, or policies of third-party services. If Polymarket's API changes, is restricted, or becomes unavailable, the Service may be affected and we may modify or discontinue the Service accordingly.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
We do not warrant:
- That the Service will be uninterrupted, error-free, or secure
- That alerts will be delivered within any specific timeframe
- That information provided by the Service is accurate, complete, or current
- That the Service will meet your specific requirements or result in any particular outcome
- That defects will be corrected
Prediction markets involve substantial risk, including total loss of capital. Past performance of any wallet, pattern, or trade mentioned in the Service does not predict future results. You may lose all of the money you use to trade on Polymarket. The Black Ledger does not and cannot reduce that risk.
11. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the total fees you paid to us in the twelve months preceding the claim, or (b) CAD $100.
- We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, trading losses, or lost data, even if we have been advised of the possibility of such damages.
- We are not liable for losses arising from your trading decisions, whether or not informed by Service alerts.
- We are not liable for third-party service failures, blockchain issues, API changes, or regulatory actions.
Some jurisdictions do not allow the limitation or exclusion of certain warranties or damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless Caden K from any claim, loss, liability, or expense (including reasonable legal fees) arising out of:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law
- Your violation of any third-party rights
- Your trading activity on Polymarket or any other platform
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including but not limited to violation of these Terms. On termination, your license to use the Service immediately ends.
You may terminate your use of the Service at any time by cancelling your subscription and ceasing to access the Service.
Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.
14. Modifications to the Service and Terms
We may modify, suspend, or discontinue the Service at any time. We may also modify these Terms. If we make material changes to these Terms, we will notify active subscribers by email and update the “Last updated” date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service will be resolved in the courts of British Columbia, Canada, and you consent to the jurisdiction of those courts.
Class action waiver: You agree that any dispute will be resolved on an individual basis. You waive any right to participate in a class action, collective action, or representative action against us.
16. General
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any provision does not waive our right to enforce it later.
- These Terms are the entire agreement between you and us regarding the Service.
- You may not assign these Terms; we may assign them in connection with a business transfer.
